Lawsuit Alleges 5 Year Old Was Sexually Assaulted by Wal-Mart Employee

A lawsuit has been brought against Wal-Mart after failure to execute security measures results in sexual assault of 5-year-old boy.

On June 23, 2016, Jeff Herman of Herman Law filed a lawsuit against Wal-Mart in The Supreme Court of the State of New York on behalf of John Doe.

“Wal-Mart undertook the responsibility to provide security for its public bathrooms given the known dangers of assaults but failed to carry out that responsibility, which led to my client being sexually assaulted,” said Herman.

According to the complaint, Mother Doe, mom of John, took him with her to Wal-Mart on October 19, 2013.

While mother was in the customer service line, John informed her that he needed to use the restroom. She allowed him to go to the restroom on his own, as she had observed a security guard at the bathroom entrance, and she knew that Wal-Mart had surveillance cameras in the store.

As John left his mother’s side, Wal-Mart employee, Matthew Bulmer, followed John around the store, and eventually into the restroom. Once outside the entrance to the bathroom, Bulmer persuaded John to come back into the bathroom with a $20 bill.

Once back inside the bathroom, Bulmer took John into a stall and sexually assaulted him. John was able to finally pull away, went straight to his mom and told her what happened.

Police were called and Bulmer admitted to sexually assaulting John and subsequently plead guilty to sexual battery.

Wal-Mart had acknowledged that this location was prone to assaults and other crimes, which is why there were security measures in place. However, at the time of John’s assault, the security cameras were not being monitored and the security guard left the entrance to the customer bathroom unattended.

Wal-Mart’s failure to adequately execute these security measures demonstrates a reckless disregard for the safety of customers.
