US Government Stay At Home Orders and Essential Real Estate Services COVID-19

Three months from when the first case of COVID-19 was discovered in the US and cases have yet to stop. As of April 22, 2020, Centers of Disease Control (CDC) reports a total of 828,441 cases, 46,379 deaths in all 55 state jurisdictions including District of Columbia, Guam, the Northern Marian Islands, Puerto Rico and the US Virgin Islands. The real estate industry is issuing new reports day by day in response to the stay at home and essential services orders related to COVID-19.


The governors of each state has amended numerous Stay At Home Orders to minimize and reduce the risk of the virus transmission. While most of the states have issued their own guidelines, most, except currently the state of Georgia, have adopted the guideline set by the US Department of Homeland Security Cybersecurity Infrastructure and Security Agency on the Identification of Essential Critical Infrastructure Workers During COVID-19 Response. According to the memorandum, as of March 28, 2020, essential services generally do include residential and commercial real estate services, including settlement services.


In Colorado, the Department of Regulatory Agencies Division of Real Estate announced, “Essential services include real estate appraisals and closings services that are needed to complete real estate transactions. Further, home inspections and final walkthroughs after a buyer has signed a purchase contract and is, therefore, a condition precedent to the actual transfer of property is also considered to be an essential part of the real estate transaction. Also, elements that are fundamental to the real estate transaction are deemed essential to support market activity. However, showing a property or conducting an open house in-person during the COVID-19 pandemic shall be avoided as it violates the specific mandates of recently issued executive and public health orders.”
