When asked for a comment, she said, "Filing for divorce can be a minefield, which is why it's important to carefully think through the following issues before formally submitting a petition for divorce. Strategically approaching a divorce will increase your chances of getting a favorable outcome."

It's vital to set emotions aside and be absolutely clear on the decision to follow through with a divorce.

"There's no doubt that choosing and going through with a divorce takes an emotional toll. But it's important that you have first explored all options - such as marriage counseling - in an attempt to make the relationship work. Once the divorce papers have been served, it's often difficult to reverse that decision," she said.

Following from this, Weinman alluded to the fact that anyone with children thinking of divorce needs to set their goals when it comes to custody.

"With the way that family courts work today, there's a good chance that you and your ex will share custody of your children. Of course, some exceptions arise in extreme situations in which the court decides that one parent is not fit for child-rearing," she said.

“Part of this preparation includes coming up with a custody arrangement that fits you and your spouse’s schedule. You’ll find that the divorce process will go much more smoothly if you can hammer out the details beforehand,” Weinman added.

Another essential thing to do before officially beginning the divorce process is to collect and organizel financial documents.

When asked to elaborate, she said, “Many people underestimate just how large of a role documentation plays in any divorce. This will probably include real estate records, mortgage documents, phone and bank account records, retirement account statements, credit card statements, car notes, etc. The best thing to do is to have all of this on hand before filing for divorce.”

Having all this information at one's disposal, Weinman added, can make it easier to come up with a general idea of how to split property, bank accounts, and assets after the divorce.

Doing the research to select the right attorney can go a long way in mitigating problems during the divorce process.
