When asked to comment, she said, “There’s no doubt that the COVID-19 pandemic has touched nearly every aspect of our lives and brought about a new era of uncertainty. This is particularly true when it comes to parenting. Many parents are wondering how COVID-19 has affected child custody, particularly with the enforcement of shelter-at-home orders.”
According to Weinman, existing child custody orders will remain in effect during the time of COVID-19.
“At the end of March, the Texas Supreme Court mandated that existing custody orders still stand despite the stay-at-home order. In other words, as a parent, you have the legal right to access and visit your children, even if there is a compulsory shelter-in-place order,” she said.
Weinman mentioned that parents should adhere to their current visitation schedule, meaning that neither side is supposed to hinder the other from seeing their children.
“However, circumstances can get more complicated during COVID-19. Let’s say that you’re keeping your children away from your ex because you think they are putting your kids at risk of getting coronavirus. In this situation, your ex could file a motion to enforce, which means that you could be held in contempt of court for not following through on a previously approved court order," she added.
“If you believe that your child is in imminent danger, then there might be ways to defend and justify yourself. After all, the family courts emphasize the best interests of the children. Before taking action, however, it’s important to first obtain legal advice from a family law attorney,” she said
Weinman further alluded to the fact that many parents are wondering if and how they could modify a child custody arrangement during the pandemic.
When asked to elaborate, she said, “The courts in Texas are continuing to operate, however, they are working at a much slower pace. During these unprecedented times, the State Supreme Court recommends working out issues with your ex to come to an agreement."
If that doesn't work, Weinman added, because the courts are prioritizing legal cases affecting child safety, it's possible to e-file a case and have it heard by the court in order to make the necessary changes to a child custody arrangement.
