Takeda Pharmaceuticals Gets $6.5 Million Actos Judgment Overturned

Japanese pharmaceutical giant, Takeda, has recently been successful in convincing a judge to overturn a $6.5 million jury verdict with regards to an Actos related lawsuit.

Los Angeles Superior Court judge, Kenneth Freeman, recently overturned a $6.5 million jury verdict in relation to a personal injury lawsuit over the diabetes drug, Actos. The judge made the decision following a motion that was filed by the manufacturer of the drug, Japanese pharmaceutical giant Takeda.

Towards the end of April, the jury awarded the plaintiff, Jack Cooper, $6.5 million in damages after he was diagnosed with cancer of the bladder. At the time of diagnosis the plaintiff had been taking the medication for four years. A doctor who testified at the trial on behalf of the plaintiff claimed that Actos had been the cause of Mr. Cooper's bladder cancer.

However, after the jury had made the multimillion dollar award, Takeda Pharmaceuticals filed a motion claiming that the drug was not responsible for the plaintiff's condition. After branding the testimony of the plaintiff's doctor 'inherently unreliable' Judge Kenneth Freeman ruled in favor of the drug manufacturer and overturned the original verdict of the jury.

Following the judge's latest verdict, Kenneth D. Greisman, senior vice president, general counsel, Takeda Pharmaceuticals U.S.A., Inc stated: "We have empathy for Mr. Cooper and his family, but agree with the court’s finding. In granting the motion, the judge ruled that the plaintiffs failed to offer any reliable evidence that Mr. Cooper’s disease was caused by ACTOS (pioglitazone HC1)."

He also told reporters that patient safety was a huge priority for the company, and that Takeda would be vigorous in the defense of any future lawsuits relating to the use of Actos. At present the company is facing several thousand lawsuits, as many decided to file an Actos lawsuit claiming personal injury over the use of the diabetes medication following the release of a 2011 study indicating a link between bladder cancer and the use of the medication.
