According to a Tennessee investigation of physician data conducted from January 2013 and July 2018 (published in the Tennessean), physicians reviewing cases for the Federal Office of Social Security were paid according to the volume of cases they reviewed, encouraging many Tennessee doctors to race through their reviews. Over half of those physicians reviewed cases at a rate faster than the federal standard (1.5 cases per hour). One out of every five Tennessee doctors reviewed cases at a rate double that speed. The investigation also found that some of the doctors under contract had a history of misconduct.

According to a report conducted by the U.S. Government Accountability Office, the odds of being allowed social security disability benefits for African-American claimants with attorney representation were more than 5 times higher than the odds of for those without attorney representation. In comparison, the odds of being allowed benefits for white claimants with attorney representation were 3 times higher than the odds for white claimants without representation.
