New Jersey Appeal Tribunal Docket # 85,928 reveals after a state unemployment investigation into (who) James Coe Jr a black severely disabled veteran fighting to avoid a January 2015 Foreclosure tipping point (what) after being wrongfully discharged by the (where) United States Postal Service, Processing & Distribution Center in Edison NJ after thirteen years of employment for (why) alleged misconduct based on Article 16.7 of the National Mail Handlers Union/CBA the state of New Jersey found no misconduct as a result of the investigation into the material facts of why the veteran was discharged.The New Jersey Labor Department issued a no employee misconduct finding and recommended that the employee be returned to duty with full employee benefits.
However, the U.S. Postal Service elected to continue its cultural pattern of official misconduct by employing a rogue convicted federal felon Arbitrator to rig the Arbitration Hearing based on an invalid U.S. Merit Systems Protection Board Last Chance Agreement wrongfully allowed on the record by the Arbitrator during the Arbitration Hearing prior to union review per National Postal Mail Handlers Union/CBA.
In addition, a rogue Arbitrator (how) allowed the U.S. Postal Service to introduce fraudulent last minute documentation into testimony during the Arbitration Hearing.
The newsworthy issue is the fact the State of New Jersey does not have the legal power to force the United States Postal Service a federal agency to obey New Jersey State law.
To date the U.S. Postal Service has failed to honor the Preference Eligible Veterans’ Act or to show any just cause under the law before discharging a Preference Eligible Veteran in gross violation of Federal Employment Law.
