He was taken into ICE custody following a removal hearing in Cleveland, OH, in March, 2018. Mr Yang was detained upon his first entry into the US in 1995, and upon his removal to China in 1996 was detained and beaten by Chinese authorities.
He escaped to the US again in 1998 and settled in Cleveland. Unaware that he had to appear before an immigration judge, he was ordered removed in his absence, but remained in the US and built a family.
The Yerman Group successfully reopened Mr Yang’s proceedings and filed an application for asylum based on his fear of persecution. At a March 2018 hearing before an immigration judge in Cleveland, OH, Yang was apprehended and remained in ICE custody for six months.
ICE reinstated Yang’s 1996 removal order, rendering him eligible to sit for a reasonable fear interview which would establish his eligibility for withholding of removal only.
