NY Assemblyman To Make Changes to State Auto Insurance Laws

New York Assemblyman, Will Barclay is to help bring change to auto insurance laws in New York.

Young and aggressive New York Assemblyman, Will Barclay plans on working to make changes to the state auto insurance laws and he begins by speaking out on the need for some critical changes.

According to Barclay, the 2 main focuses he would like to see changed would be to bring down insurance fraud and decrease the cost of auto insurance. New Yorkers all know that auto insurance in the Big Apple is extremely high and ranked as the 3rd most expensive in the country. Insurance companies are also falling prey to numerous fraudulent claims such as staged accidents and the recruiting of injured passengers and drivers for the purpose of making insurance claims, charging doctor’s fees and lab tests which aren’t even necessary or done at all.

Last year, 36 people were charged with a $279 million insurance fraud case and 135 doctors that submitted insurance claims that were found to be questionable. These are just 2 of the more prominent cases which helped prompt authorities to make some reforms in the insurance system.
Assemblyman Barclay says that the reforms, while good, are not enough. These reforms merely touch the surface of the problem like a quick response system for health care providers and the changes in requirements of insurance providers to pay for treatment over and beyond established fees, if the treatment was even provided for to begin with.

The focus of the Assemblyman is to introduce new legislation to bring down the no-fault personal injury claims and increase penalties for insurance fraud. Fortunately, he has millions of New Yorkers willing to support his cause. There are concerned groups in the city that have been actively demanding better state laws on auto insurance like the New Yorkers Stand Against Insurance Fraud or the NYSAIF. Senator Marty Golden has been after reforms to go after those behind insurance fraud since the beginning of 2012 after the Midwood car fire bombings in November of 2011.

According to Senator Golden, these fraudsters are driving up the cost of auto insurance while terrorizing the communities and neighborhoods because the city’s no-fault auto insurance law is full of loopholes. He says that these criminals have forced New Yorkers to pay “53% more than the average American for auto insurance.”
