New Mexican media and law enforcement campaigns have been making residents aware of the dangers of drinking and driving, and new statistics show the message appears to be working as the decreasing trend has continued in the first months of 2013."The Szantho Law Firm wants the safety of all first and foremost. Efforts by the State of New Mexico have helped. Strong legislation passed in the late 1990’s and early 2000’s have resulted in far fewer fatalities, with almost a one-third reduction of deaths due to drunk driving in 2012 when compared with 2002. Data for the first 2 months of 2013 indicate that law enforcement and other means are helping to further curb incidents of DWI with less than half the losses than the same period last year.
Still, The Szantho Law Firm indicates that it does see more incidences of drunk driving near holidays and major sporting events. They remind drivers to plan ahead by designating a driver or securing other means of travel, rather than risking an accident or the legal ramifications that come with a DWI conviction.

For those who believe that they can avoid a first DWI charge by refusing a breathalyzer, Mr. Szantho offers some cautionary advice, “When it comes to the breath test, people can refuse to take a breath test in New Mexico, but they need to know that the mandatory jail time increases to two days on a first DWI offense when convicted. Refusing the breath test can be advantageous because a measure of the blood alcohol level is then absent. However, erratic driving and signs of intoxication can be considered for conviction and sentencing. A person must assess the risk of not taking a breath test because each individual case will be different.”
