A settlement of $2,500,000.00 was negotiated by partner Glenn Kimelman on behalf of a client in the City of New York who was injured when the vehicle he was operating was struck by a New York City Fire Dept. ambulance. Plaintiff was stopped in a marked bus stop discharging passengers when the ambulance rear-ended and side swiped the bus. The driver of the ambulance admitted at her deposition that she misjudged the amount of space available to pass the bus.The action was pending trial in Queens County when a settlement was reached with the Chief Negotiator for the NYC Tort Dept. Plaintiff had surgeries to his cervical and lumbar spines and was never able to return to work. Complications from the surgeries included an infection requiring hospitalization and a broken screw in the cervical area which had to be surgically removed. The surgical procedures used by the spinal surgeon entailed an innovative technique after which plaintiff was asked for his testimonial to attract future candidates. Negotiations by counsel included resolving a workers’ compensation lien in excess of $300,000.00 and preparing a Medicare set aside account for future medical care.
