When asked to comment, he said, “Everyone’s lifestyles have drastically shifted with the onset of the COVID-19 pandemic, with New York’s issuance of a stay-at-home order to help prevent the spread of the virus. In this context, many parents are wondering how these new measures affect child custody and visitation rights.”
The most important thing that parents need to know, according to Breud, is that the terms laid out in existing child custody arrangements remain valid during stay-at-home orders.
“While these orders are in place in New York, legally, you must still meet your obligations spelled out under a child support order. This also means that you have a legal right to see and visit your kids during COVID-19. In other words, orders remain in effect and enforceable,” he added.
Following from this, parents are not advised to stray from their existing visitation timetable unless both parties have reached an alternative agreement.
When asked to elaborate, Breud said, "It's quite possible that family dynamics can quickly become complicated during the time of coronavirus. For instance, you might be afraid that your ex is placing your child at risk of getting the virus, and because of this, you withhold your child from your ex. In this case, your ex has legal rights to child visitation and could file a motion to enforce the current order, which means that you could be held in contempt of court.”
“There could be ways to sidestep this issue if you believe the health and wellbeing of your child are in danger. Keep in mind that family courts generally operate on the notion of doing whatever is in the best interests of the children. The best thing to do at this point is to contact an experienced family law attorney before taking any steps that could get you in legal trouble,” he said.
Breud further pointed to the fact that many parents are curious as to how they can change a child custody order during COVID-19.
“However, because of the current situation, there might be some delays. If possible and you’re on good terms with your ex, we suggest trying to strike an agreement with your ex, particularly if the changes are temporary. If that doesn’t work, then you might need to turn to the courts,” he said.
