Collective Legal Action Certified Against Homeland Health Care Subsidiary Reports Overtime Lawyer

A class action has been conditionally certified by the U.S. District Court, Stampolis et al v. AHB Sales, LLC, according to the plaintiffs counsel Richard Celler Legal, P.A.

A plaintiffs class action has been certified after a filed motion to dismiss was denied by the Southern District Florida Court. The case, Stampolis et al v. Ahb Sales, LLC, (a subsidiary of Homeland Health Care), includes plaintiff allegations over unpaid overtime and that non-exempt sales employees were made to regularly worked 60-70 hour weeks and were punished individuals for taking lunch breaks according to court documents. The class action request has been granted by the court and employees who qualify to join this action were given an opt-in consent deadline of October 7, 2016 according to plaintiffs counsel at Celler Legal, P.A.

According to court documents, at least 10 additional employees consented to opt-in since the case was initially filed. Sales representatives for the defendant were allegedly working for "hourly plus commission" selling insurance products by phone.

According to the court, the initial plaintiffs complaint sufficiently alleged both elements of an unpaid overtime claim.

According to the Celler Legal website, the general rule is that employees who do not receive at least 15 minutes of uninterrupted free time, without any work tasks, are entitled to be paid for this work time. It is illegal for employers to deduct non-exempt workers for this time,

The Fair Labor Standards Act (FLSA) legally obligates covered employers to pay overtime, Successful FLSA claims may be able to recover wages wrongfully withheld from affected employees.

In this case (STAMPOLIS et al v. AHB SALES, LLC Case: 0:15-cv-62447-JAL), proposed class members will be notified by mail on or before August 5, 2016, with consent to join forms due by October 7, 2016.
