Carl’s Jr. will go down in the marijuana history books as the first ever Fast-food chain to serve a CBD infused burger in honor of the national weed holiday 4/20.

— National weed day is usually a favorite among marijuana users, and Carl’s Jr. will be a friend to many this coming Saturday, April 20th, 2019 although the announcement comes as a surprise because of the gray legalities of CBD additives in food and drinks.

Carl’s Jr is setting the bar for every fast food super chain this year as the first of its kind to add a CBD- infused burger to its menu. Early this morning in a press release, “The new Rocky Mountain High: CheeseBurger Delight ties back to our core strategy of being the first to bring bold and unexpected flavors that are at the forefront of hot restaurant trends to a quick service menu,” said Patty Trevino, Carl's Jr. senior vice president of brand marketing.

Carl’s Jr. announced that the Rocky Mountain High: CheeseBurger Delight will be available only on April 20 at one restaurant, located at 4050 Colorado Boulevard in Denver. Price tag: $4.20. Sales begin at 6 a.m. when the restaurant opens.

According to Carl’s, the new limited-edition burger will contain two juicy patties topped with pickled jalapenos, pepper jack cheese, crunchy fries, and don't forget the secret ingredient Carl’s Jr. Santa Fe Sauce infused with hemp-based CBD oil produced by Colorado-based Bluebird Botanicals.

All this food contains a small dose of 5 milligrams of hemp-derived CBD extract.

Unlike the THC, CBD is a non-psychoactive part of cannabis, which means that it will not produce a high when consumed unless activated with THC. CBD has become modern medicine to many American due to the effects it gives, including feeling calm, well-being, relaxation, and the various health benefits it supposedly offers.

Since the compound was legalized through the Farm Bill- hemp has erupted and flooded every market. The Farm Bill moved hemp—cannabis or cannabis derivatives with low THC thresholds below 0.3% by weight—to its category, separating it from the federal list of controlled substances.

At the moment former FDA Commissioner Scott Gottlieb declared in December 2018, “It’s unlawful under the [Food Drug & Cosmetic Act] to introduce food containing added CBD or THC into interstate commerce, or to market CBD or THC products as, or in, dietary supplements, regardless of whether the substances are hemp-derived. … It’s illegal to introduce drug ingredients like these into the food supply or to market them as dietary supplements. This is a requirement that we apply across the board to food products that contain substances that are active ingredients in any drug.”

So, since the FDA has not yet approved the additive in any form of food or drink, even though marijuana may be legal in certain areas, no restaurant food or beverage containing THC or CBD is not allowed. Other states have also tightened the regulations when it comes to the CBD additives, like New York and L.A...
