New 2016 Driving Laws Designed to Make the Road Safer for Everyone

California drivers can look forward to several new laws in 2016 that are designed to make the road a safer place for child passengers, drivers, bicyclists and pedestrians. As of January 1, 2016, law SB491 states that it is now illegal to wear earbuds in both ears or to wear over-the-ear headsets while driving a vehicle or riding a bicycle in the state of California. However, this law does not apply for those who drive emergency vehicles or drivers who wear ear coverings for safety reasons.

Under SB61, a 1-year extension to a pilot program in Alameda, Los Angeles, Sacramento and Tulare counties, all individuals who have been convicted of driving under the influence must now install an Ignition Interlock Device to their vehicles. Issuing Alerts for Hit and Run Incidents

Law enforcement agencies are now able to issue Yellow Alerts if a person has been killed or seriously injured in a hit-and-run incident if law enforcement officers have information about the suspect or their vehicle, including partial license plate numbers. The AB8 law also allows California Highway Patrol to use digital message signs to put out the Yellow Alert and encourages television, cable, satellite systems and radio to pass on any identifying information.

Bicycle Safety

Law AB208 broadens the terms of an existing law that requires slow-moving passenger vehicles to pull over safely and let traffic pass on state highways. The new law now applies to bicycles as well and states that bicycles must use the next available turnout or other safe area to let backed-up traffic of five or more vehicles pass.

Changes for Drivers in 2017

According to SB491, motorists involved in traffic accidents that result in property damage of at least $1,000 must report it to the California Department of Motor Vehicles using an SR-1 form. Previously, in a law that was updated in 2002, motorists were required to report accidents resulting in more than $750 in damages.

Law AB53 states that all children under the age of 2 must be secured in a rear-facing child passenger restraint system when riding in a motor vehicle, unless the child weighs 40+ pounds or is 40+ inches tall.
