Cabeau, the creator of luxurious yet affordable travel products, recently took swift action to prevent the displaying and subsequent sale of knockoff products at international trade shows. The rapid response by Cabeau’s intellectual property department is another demonstration of the company’s unyielding pursuit to prevent infringement of the brand’s patented and trademarked products at trade shows across the globe.On March 18, 2016, Cabeau concluded a lawsuit involving infringement of its intellectual property rights by Relaxus, a Canadian manufacturer and distributor of consumer products. While attending a trade show, Cabeau discovered that Relaxus was displaying products at their booth that infringed upon Cabeau’s intellectual property protecting its patented Evolution® Pillow product. Cabeau filed an infringement and unfair competition lawsuit in the United States District Court for the Central District of California, which resulted in Relaxus immediately ceasing the sale of their infringing product and agreeing to Cabeau’s proposed settlement terms. As part of the settlement agreement, Relaxus paid an undisclosed monetary amount to Cabeau, who in turn filed a dismissal of the lawsuit without prejudice.
Cabeau and Relaxus are currently exploring ways to work together in the future to distribute authentic Cabeau products. While Cabeau’s goal is to vigorously enforce its intellectual property rights, they welcome the opportunity to build strong, long-term partnerships around the world to promote Cabeau’s products and technology.
More recently, at an international trade show in Las Vegas in March 2016, it was discovered that two exhibitors were displaying travel pillows manufactured in Mexico that clearly infringed upon patents, trademarks, and copyrights protecting Cabeau’s Evolution® Pillow. Cabeau took immediate action, leading to the same day removal of the infringing products from both booths with written assurances that the infringing products would be taken off the market.
