However, Wilson will be subject to tax on her winnings. Sacks explains that winnings from playing poker, collected by non-residents playing in the U.S., could be considered income by the IRS and subject to a 30% withholding tax. But it depends on the players’ country of origin. Only a small number of countries have signed a tax treaty with the U.S., which includes Canada. If the player resides in a country that has not signed a tax treaty with the U.S., 30% of their winnings will also be withheld. Some of the countries that have not signed a treaty include: Australia, China, India, Mexico, New Zealand, Saudi Arabia, and Thailand.

According to Sacks, while there is a way for Canadians or any non-U.S. resident to get some or all of the 30% withholding tax back, it means having to deal with the IRS. But IRS tax refund regulations and forms are both difficult and confusing.
