Philadelphia Law Firm Francis & Mailman, P.C. Gets Record $60 Million verdict in California FCRA Class Action against Trans Union.

On June 20, 2017, the law firms of Francis & Mailman, P.C., Philadelphia, and Anderson, Ogilvie & Brewer, LLC, San Francisco, obtained the highest jury verdict in the history of the Fair Credit Reporting Act. In a class action brought against the Trans Union credit reporting agency based upon its practice of falsely associating consumers with the federal government’s OFAC terrorist watchlist, a San Francisco jury awarded the class $60,055,800 in statutory and punitive damages.


The Office of Foreign Assets Control (OFAC) is a financial intelligence and enforcement agency of the United States Treasury Department responsible for planning and executing economic and trade sanctions in support of national security and foreign policy.


On behalf of a class of similarly situated individuals, representative Sergio L. Ramirez brought a case against Trans Union after he was denied the ability to buy a car when Trans Union reported that he was a narcotics kingpin on the government’s OFAC list. Ramirez had a different middle name, date of birth, and address from any of the records Trans Union associated with him. Defendant Trans Union sent him documents that failed to tell him how he could remove that inaccurate information from his credit report.


The jury found unanimously in favor of the Class on all counts, and found that Trans Union willfully violated the Fair Credit Reporting Act.
