In 2012, Colorado passed Amendment 64, legalizing marijuana. This has had a positive impact on Colorado’s economy, as it has saved the state enforcement costs and has brought in an estimated $80 million in revenue. However, it has long-since been believed that this has had a major impact on enforcement costs and arrests throughout Nebraska, and the researchers set out to determine if the perception was accurate. The researchers assembled data from four years prior to Colorado’s legislative change, as well as from 2014, the first year Nebraska’s statistics are available following the new legislation.
From 2013 to 2014, there was an 11-percent increase in arrests for marijuana-related crimes in Nebraska. Although some areas saw a decrease, others, such as the counties I-80 runs through, the panhandle, and the Colorado border saw a marked increase. The offense with the greatest increase in arrests has been possession. The overall costs of enforcement have also skyrocketed. In 2013, Nebraska spent approximately $9.2 million, when accounting for revenue. Just a year after the Rocky Mountain State changed its laws, Nebraska enforcement costs rose 11.6-percent, to $10.2 million.

The majority of Mr. Stockmann’s cases surround arrests that occurred near Interstate 80. This was reflected in the new data published, as approximately 63-percent of Nebraska’s total arrests occur in this region. Although it’s unclear whether these increases stem purely from the legislative changes or Nebraska law enforcement stepping up patrols, the $10.2 million tab still falls upon Nebraska taxpayers to cover the expenses.
