Clear Law state that compensation for delayed flights is being awarded to consumers under the terms of EC Regulation 261/2004, and has been extended following recent decisions of the European Court of Justice.

If the flight was cancelled, delayed by more than three hours in arriving, or the passenger was denied boarding on the flight against their will, the passenger may be entitled to claim up to €600 in flight delay compensation per passenger.

It is worth noting that in order to progress any delayed flight compensation claim there are a few required stipulations:

- In the case of delayed claims, the passenger must be delayed arriving into the scheduled arrival airport by at least three hours;

- The flight must have been departing from an airport based within the EU, or arriving into an airport based in the EU on an airline registered in the EU. Therefore if flying from New York to London on a British Airways flight, a claim would be possible; whereas if flying from Delhi to London on an Air India flight,the claim would not be possible;

- The flight must have been within the past 6 years in order to be eligible to claim;

- The passenger must be a fee paying passenger (Air Miles are included), with a confirmed reservation on the flight and with the exception of cancelled flights and must have checked-in within 45 minutes of the departure time;

- The airline must not be able to demonstrate that the cancellation or delay was caused as a result of ‘extraordinary circumstances'.
