Lawsuit Against University and Fraternity for Rape of Student

On June 15, 2016, Jeff Herman of Herman Law filed a lawsuit against Indiana University of Bloomington and Delta Tau Delta in The United States District Court Southern District of Indiana, Indianapolis Division on behalf of Jane Doe.

“There were many red flags that both the school and the fraternal organization ignored which ultimately led to my client being sexually assaulted,” said Herman.

According to the complaint, Doe, a student at IU, attended a party hosted by DTD at the DTD House on or about April 11, 2015. Doe passed out after drinking copious amounts of alcohol only to be awakened by John Enochs, a student at IU and a member of DTD, forcefully raping her.

Prior to the alleged sexual assault of Doe by Enochs, IU was well aware of the prevalence of sexual assaults on the IU campus, and IU fostered an environment of foreseeable, rampant and unpunished sexual assault.

DTD was well aware of the prevalence of sexual assaults on the IU campus and sexual assaults in fraternity houses at IU and across the country and multiple previous allegations of sexual assault specifically at DTD at IU.

Despite an allegation against Enochs of sexual assault by another female IU student being reported to IU Police Department on or about October 2013, Enochs continued to be enrolled at IU and continued to have unrestricted access to women on campus.

“Fraternities must do more to stop underage drinking and protect students from sexual assaults,” said Herman. “Unfortunately, the only way to get real change is to hold fraternities financially responsible for harm caused in their houses. Universities, too, must do more to protect their students. This is not a new problem and it is time for action, not just talk.”
