Lawsuit Against Day Care and Worker for Assault on Two-Year-Old Girl

Herman Law has filed a lawsuit on behalf of a two year old who was sexual assaulted at Little Hands at Work and Play, a day care center located in Nebraska.

On June 16, 2016, Jeff Herman of Herman Law filed a lawsuit against Little Hands At Work And Play, as well as Mark Mays in The District Court of Douglas County, Nebraska on behalf of Jane Doe.

“The day care breached its duties by failing to protect my client from being sexually abused,” said Herman. “In order to keep children safe, we must expose predators and institutions that protect them.”

According to the complaint, Doe, a two-year-old girl, attended day care at Little Hands At Work And Play. Mays was employed by Little Hands, providing day care services to Doe, and ultimately sexually assaulted the little girl while in his care at the day care facility.

In January 2016, the Omaha Police Department was dispatched to Little Hands after an employee witnessed Mays in a bathroom with the two-year-old girl. At the time, the child was naked from the waist down.

When interviewed by the police, Mays admitted to the assault that the employee had witnessed in the bathroom. He also proceeded to disclose to police that he had assaulted 3 other little girls during his employment at Little Hands from December 2015 to January 2016.

One of the four little girls that Mays admitted to sexually assaulting was Doe.

While at Little Hands, it was the day cares responsibility to ensure the well being of all children who are in their care. Due to the scope of Mays’ duties while at Little Hands, which included being allowed to place children on his lap, both the day care and worker are responsible for the acts committed.

Mays also stated that he had assaulted four girls at another day care facility he had previously employed at, Le Petite Academy in Omaha, Nebraska.
