The California surrogacy process, legally speaking, has just gotten a major makeover, due to take effect January 1, 2017. The new legislation helps ensure that intended parents are legally protected, as long as the surrogacy process occurred in California or the parties resided in California while it commenced. Although the state is already known for being incredibly friendly to those on the journey, the new laws create further protections and of special importance to the LGBT community.

Assembly Bill 2349 was recently approved and sent to Governor Jerry Brown for the final decision. He signed it into law on September 16, though the changes will not take effect until the start of the new year. AB 2349 is unique in that it ensures cases involving California surrogacy are heard in the state’s courts, which already provide immense protection to intended parents. Unlike other states that lack legislation or have unfriendly laws regarding the surrogacy process and rights, California has been leading the nation with progressive guidelines that make it a smooth journey for everyone involved.


The new laws also aim to protect the LGBT community, as these families face even greater challenges where parenting rights are concerned. In many cases, people rely on the help of family and friends to start their families, but this also poses problems when a surrogate changes her mind or decides she wants to keep the baby. Though instances like this are exceeding rare, even one occurrence too many, so it’s of great importance that the cases are heard in the Golden State where the rights of all intended parents are protected.


“LGBT parents are especially vulnerable when our community is targeted with discriminatory laws,” says executive director of Equality California, Rick Zbur. ““This law will strengthen the rights of California LGBT parents whether their children are born in or out of state from the moment of conception, through birth and beyond.”

The bill was sponsored by Assemblymember David Chiu, whose website explains “In the midst of the backlash against the Supreme Court’s historic same-sex marriage decision and the push for so-called “religious freedom” laws that seek to legitimize discrimination, some states are looking for new ways to undermine the legal recognitions afforded to same-sex couples and their children. One of the only recognized bases for refusing to grant full faith and credit to a court judgment is to assert that the court rendering the judgment lacked jurisdiction.” AB 2349 makes the necessary clarifications, so that all parties are protected. At a time when some states still place the rights of intended parents in jeopardy, the new laws go the extra mile and make sure the same rights apply to every intended parent, regardless of their orientation.
